Terms of Service

1. Service Description

KX Trader is an AI-powered forex and cryptocurrency trading bot that generates trade signals based on algorithmic analysis of market data. The Service includes:

• Automated trade signal generation and delivery via Telegram
• Optional automated trade execution through the Forex.com trading API
• A subscriber dashboard for monitoring trade performance and managing your account
• Performance tracking and trade history reporting

The Service is provided on a subscription basis. KX Trader does not manage your trading account directly. All trades are executed within your own Forex.com brokerage account under your full control and responsibility.

2. Subscription Terms

• Subscriptions are available on a monthly or yearly billing cycle.
• All subscriptions automatically renew at the end of each billing period unless cancelled prior to the renewal date.
• Payments are processed through OxaPay. You are responsible for ensuring your payment method is valid and funded.
• Pricing is subject to change. Any price changes will be communicated at least 30 days before taking effect and will apply at your next renewal date.

3. Cancellation and Refunds

• You may cancel your subscription at any time through the subscriber dashboard or by contacting support.
• Upon cancellation, you will retain access to the Service through the end of your current billing period. No further charges will be applied.
• No refunds are provided for partial billing periods. If you cancel mid-month, you retain access for the remainder of that month but will not receive a prorated refund.
• We reserve the right to issue refunds at our sole discretion in exceptional circumstances.

4. Acceptable Use

By using the Service, you agree not to:

• Redistribute, resell, or share trade signals with any third party, whether for commercial or non-commercial purposes
• Reverse engineer, decompile, disassemble, or attempt to derive the source code or underlying algorithms of the Service
• Use the Service to engage in market manipulation or any activity that violates applicable laws or regulations
• Interfere with or disrupt the Service, its servers, or networks connected to the Service
• Create multiple accounts to circumvent subscription requirements or abuse promotional offers
• Use automated tools, bots, or scrapers to access the Service beyond its intended interfaces

Violation of these terms may result in immediate termination of your account without refund.

5. Account Responsibilities

• You are solely responsible for maintaining the security of your Forex.com brokerage account, including your API credentials.
• You are responsible for setting appropriate risk parameters, position sizes, and stop-loss levels within your brokerage account.
• KX Trader acts on your behalf based on the permissions you grant. You acknowledge that you are responsible for all trades executed in your account, whether initiated manually or by the Service.
• You are responsible for ensuring that your use of the Service complies with all applicable laws in your jurisdiction.

6. Service Availability

The Service is provided on a best-effort basis. We do not guarantee uninterrupted, error-free, or continuous availability of the Service. Downtime may occur due to maintenance, system updates, API provider outages (including Forex.com and Telegram), or circumstances beyond our control. We will make reasonable efforts to notify subscribers of planned maintenance in advance, but we are not liable for any trading losses or missed signals resulting from Service interruptions.

7. Limitation of Liability

• To the maximum extent permitted by law, Vision Dev Stacks LLC, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• We are not liable for any trading losses, including but not limited to losses resulting from signal inaccuracy, execution delays, API failures, or system downtime.
• Our total liability to you for any claims arising from or related to the Service shall not exceed the total amount you paid to us in the six (6) months preceding the claim.
• You use the Service at your own risk. Past performance of trade signals is not indicative of future results.

8. Modification of Terms

We reserve the right to modify these Terms at any time. For material changes, we will provide at least 30 days' notice via email or through the subscriber dashboard before the changes take effect. Your continued use of the Service after the effective date of any modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must cancel your subscription before the changes take effect.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to, violation of these Terms, fraudulent activity, or abusive behavior toward our staff or systems. Upon termination, all rights granted to you under these Terms will immediately cease.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts within the United States.
